Watch what you say around the hallways, you never know who is listening. Anytime you are in court, be very careful about any conversation you have anywhere in or around the building. You may think that you know who the other party's lawyer is, but what if they have an associate working with them that you have not met? What if they have changed lawyers? What if that person sitting on the bench next to you is your ex's new fling?
Anything that you say out loud is fair game to bring up in court unless there is a reasonable expectation of privacy. For example, you look around and see that there is no one around you and you are talking to your attorney, there is a reasonable expectation of privacy because you tried to find a secluded space. If later, you find that your ex was sitting in the tree, they can't use anything said in that conversation against you.
If, however, you walk out of a hearing and being yelling at your lawyer, that conversation may come up in front of the judge since you didn't take any steps to make sure no one else heard it.
